Overview
Welcome to Sandal 'n Shoe. The terms "we", "us" and "our" refer to Sandal 'n Shoe, a footwear and accessories retailer based in Dhaka, Bangladesh. We operate our website and our Android app (together, the "Services"), including all related information, content, features, tools, products and services. Sandal 'n Shoe is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy and Delivery Information, describe your rights and responsibilities when you use the Services. By visiting, using or buying through our website or app, you agree to these Terms. If you do not agree, please do not use the Services.
1. Access and account
You must be at least 18 years old, or use the Services with the permission and supervision of a parent or guardian. You can sign in through Shopify Customer Accounts on the website or in the app. You agree that the information you give us (name, phone number, email, delivery address and payment details) is correct, current and complete.
You are responsible for keeping your sign-in secure and for all activity on your account. You may not transfer, sell or share your account with another person.
2. Our products
We try to show product details, colours and sizes as accurately as possible, but colours can look different depending on your screen. Product descriptions, availability and prices may change at any time without notice. We may discontinue a product or limit quantities per customer, area or order (for example, bulk orders).
3. Orders
When you place an order on the website or in the app, you are making an offer to buy. Your order is accepted only when we confirm it. We must receive your payment before your order is accepted. We may decline or cancel an order, for example if a product is out of stock, a price was shown incorrectly, or we suspect fraud. If we do, we will contact you using the phone number or email you gave us and refund any amount you paid.
Please check your order carefully before you submit it. We may not be able to change or cancel an order once it has been confirmed and packed. Returns and exchanges are covered by our Refund Policy.
You agree that your purchases are for personal or household use and not for resale.
4. Prices and payment
All prices are in Bangladeshi Taka (BDT). The price charged is the price shown when you place your order. Delivery is charged separately, as shown at checkout before you pay. Prices, discounts and promotions may change without notice, and promotions may have their own terms, which apply if they conflict with these Terms.
Payments are processed securely by our payment provider, SSLCOMMERZ, using a debit or credit card or mobile banking such as bKash and Nagad. We do not see or store your full card or wallet details. You confirm that you are authorised to use the payment method you choose and that the payment details you provide are valid.
5. Delivery
We deliver to all 64 districts of Bangladesh through our courier partners. Delivery times, currently 24 to 36 hours from order confirmation, and charges are explained on our Delivery Information page. Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by couriers, incorrect or incomplete addresses, or events outside our control. Responsibility for the products passes to you once they are delivered to the address you gave us.
6. Our mobile app
Our Android app is provided for your personal, non-commercial use. You can download it from the Google Play Store, and your use of Google Play is also subject to Google's terms. The app may ask for optional permissions, such as your location to find nearby stores. You can refuse or withdraw these at any time in your device settings, as explained in our Privacy Policy. We may update the app or stop supporting older versions, and some features may need the latest version to work. Orders placed in the app are governed by these Terms in the same way as website orders.
7. Intellectual property
Our Services, including our name, logos, designs, text, images, product photos and videos, are owned by Sandal 'n Shoe or our licensors and are protected by the copyright and trademark laws of Bangladesh and other countries. You may use the Services for personal shopping only. You must not copy, reproduce, republish, sell or use any of this content without our written permission. Shopify's name and logo are trademarks of Shopify. Other brand names shown on the Services belong to their owners.
8. Optional tools and third-party links
The Services may include tools or links provided by third parties, such as maps, courier tracking pages, payment pages and social media. We do not control these third parties and are not responsible for their content, products or policies. Your use of them is at your own risk and subject to their terms.
9. Relationship with Shopify
Sandal 'n Shoe is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Sandal 'n Shoe. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sandal 'n Shoe, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Sandal 'n Shoe.
10. Privacy
All personal information we collect through the website and the app is handled as described in our Privacy Policy. Some information may also be processed by Shopify under Shopify's Privacy Policy. Because the Services are hosted by Shopify, information you submit is shared with Shopify and with service providers that may be located outside Bangladesh, only to provide the Services to you.
11. Reviews and feedback
If you send us reviews, ideas, suggestions or other feedback, you allow us to use, publish and display it free of charge for any purpose, including marketing. You confirm that your feedback is your own, is honest, and does not break any law or anyone else's rights. We may remove any feedback we find unlawful, offensive or misleading.
12. Errors and inaccuracies
Information on the Services may occasionally contain errors in product descriptions, prices, promotions, delivery charges, delivery times or availability. We may correct errors, update information or cancel orders if information was wrong, even after you have placed your order. If we cancel an order you have paid for, we will refund you in full.
13. Prohibited uses
You may use the Services for lawful purposes only. You must not use them to break any law; to infringe our or anyone else's rights; to harass or harm our staff or other people; to send false or misleading information, spam or malicious code; to pretend to be someone else; to copy, scrape or resell any part of the Services; or to interfere with their security or operation. We may suspend or close your account if you break these Terms.
14. Termination
We may suspend or end your access to the Services at any time if you break these Terms. You will still be responsible for any amounts you owe. The sections on intellectual property, feedback, disclaimers, limitation of liability, indemnification and governing law continue to apply after termination.
15. Disclaimer of warranties
Information on the Services is provided for general purposes only. Except as stated in these Terms or required by law, the Services and products are provided "as is" and "as available", without warranties of any kind. We do not guarantee that the website or app will always be available, uninterrupted, secure or error-free. Nothing in these Terms limits any rights you have as a consumer under the laws of Bangladesh.
16. Limitation of liability
To the fullest extent allowed by law, Sandal 'n Shoe, our staff, partners and service providers, and Shopify, are not liable for any indirect, incidental, special or consequential loss, such as lost profits or data, arising from your use of the Services or any product. Our total liability for any claim related to an order is limited to the amount you paid for that order.
17. Indemnification
You agree to compensate and defend Sandal 'n Shoe, Shopify and our affiliates, staff and service providers against any claims, losses or costs, including reasonable legal fees, arising from your breach of these Terms, your breach of any law or anyone else's rights, or your misuse of the Services.
18. Severability, waiver and entire agreement
If any part of these Terms is found to be unlawful or unenforceable, it will be enforced as far as the law allows and the rest of the Terms will still apply. If we do not enforce a right or provision, that is not a waiver of it. These Terms and the policies linked above are the entire agreement between you and us about the Services and replace any earlier versions.
19. Assignment
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours without notice to you.
20. Governing law
These Terms are governed by the laws of the People's Republic of Bangladesh. Any dispute will be subject to the jurisdiction of the courts of Dhaka, Bangladesh.
21. Changes to these Terms
We may update these Terms from time to time by posting the new version here and changing the "Last updated" date. Material changes will be announced as required by law. Using the website or app after a change means you accept the updated Terms.
